What are the penalties for a vehicular manslaughter charge?

In any accident where someone was injured, blood tests are typically required of all drivers involved. If test results suggest that you were impaired, and you were in an accident where someone died, including if the crash caused a pregnant woman to miscarry, you could be confronted with a DUI manslaughter charge, which is formally called a vehicular homicide offense.

Vehicular manslaughter is often charged as a second-degree felony, meaning:

  • $10,000 in fines
  • Up to 15 years in prison
  • Mandatory, permanent license revocation*

What if you are also being charged with a DUI hit and run? If the prosecutor believes you knew that you caused the accident, and that you failed to stop, give information, and give what help was possible, then you would face a first-degree felony charge. Formally speaking, a hit and run charge is filed as a charge of leaving the scene.

If charged with vehicular homicide and leaving the scene, you could face:
