What Is Considered Assault or Battery in Florida?

Under Florida law, assault is known as a threat, either a word or action, to physically harm another person. This threat must be accompanied by the apparent ability to carry through with that violence at the time the threat is made, and so instill fear in the alleged victim that he or she will be harmed. If you are convicted of simple assault, you could face up to 60 days in jail, 6 months of probation, and fines of up to $500.

Battery consists of inflicting violence on another person, such as touching, striking, or causing physical harm to them. You can be charged with battery for grabbing someone, throwing something at them, or hitting, punching, kicking, or otherwise striking them—whether or not the alleged victim was injured. Simple battery is a misdemeanor that could mean up to 1 year in jail, 1 year of probation, and up to $1,000 fine.

Assault and battery charges that allege violence against a firefighter, emergency medical technician, or law enforcement personnel will result in more serious charges and penalties.

  • Thank you Brad for representing me and getting the job done!

“I would like to thank Brad Waldrop for his representation in my Community Control violation case. I was facing 48 months in Florida State Prison in Flagler and Saint Johns County. From the moment I first called and Spoke to Mr. Waldrop to the end of my case he remained professional, knowledgeable and encouraging. Mr. Waldrop responded to all of my e-mails in a timely manner even when he was on vacation this man answered my questions via e-mail. The final outcome of my case ended up with a reinstatement of Community Control in both Flagler and Saint Johns County. I never thought that I would be able to avoid prison as I was charged with Aggravated Stalking which carries a mandatory prison sentence. Mr. Waldrop in my opinion is an excellent Attorney and I would recommend him to anyone seeking legal aid. Thank you Brad for representing me and getting the job done!!”
